General Conditions of Sale

1. General terms

Customers who complete and confirm the order form on this website agree to these General Conditions of Sale of Du Rhône Chocolatier SA. The General Conditions shall be the only ones applicable to the subsequent contract.

2. Delivery Terms – Carriage – Charges

The customer must give full and accurate data, such as name, address of recipient, etc., required to enable delivery to be made under normal circumstances. After payment has been accepted, Du Rhône Chocolatier SA undertakes to sell and dispatch the products ordered by the customer by a reputable carrier as soon as possible. Delivery charges are set according to the weight of the package (weight of packaging plus product ordered) and the destination zone. No damages may be claimed if delivery is delayed. In no event may Du Rhône Chocolatier SA be held liable for any deterioration that may occur in the products if the package has been opened on route, or if the recipient is absent when the package is delivered. “Du Rhône Chocolatier” products are handcrafted in Geneva, Switzerland, and are available in limited quantity. Statements about them are made in accordance with Swiss law.

3. Prices and payment

The prices of the products are net and inclusive of all tax. An additional charge is made for carriage (transport). Products ordered on-line may only be paid for with PAYPAL or one of the following credit cards: MASTERCARD, VISA, AMERICAN EXPRESS, on-line through the web. Payment by credit card is confirmed immediately. No product will be dispatched until payment has been confirmed.

4. Delivery time

As delivery times are longer during holidays (e.g. St. Valentine’s Day, Easter, Mother’s Day and Christmas), customers should plan their orders accordingly.

5. Claims

All claims must be sent within a maximum of 48 hours after receipt of the package, to Customer Services, Du Rhône Chocolatier SA, Rue de la Confédération 3, 1204 Geneva, by recorded delivery letter. No claim will be accepted beyond this time limit.

6. Force majeure

Du Rhône Chocolatier SA accepts no responsibility for non-execution of the contract due to reasons beyond its control, such as, in particular: strikes, terrorist acts, war, natural disasters, or problems affecting suppliers and carriers. Each party shall be entitled to a reasonable additional period for execution; however, if such circumstances last for more than 60 days, the contract may be cancelled by written notice given by either party, without indemnity.

7. Data Protection

Personal data obtained from the customer by Du Rhône Chocolatier SA are kept and processed in accordance with the legislation applicable in Switzerland.

8. Applicable Law / Partial Nullity / Amendments / Jurisdiction

These General Conditions of Sale are governed exclusively by Swiss law. If part of these General Conditions of Sale is declared null and void by a court, this shall in no way affect of the remaining terms of the General Conditions of Sale in any way.

Du Rhône Chocolatier SA reserves the right to amend these General Conditions of Sale at any time. The parties recognise the exclusive jurisdiction of the Courts of Geneva for all claims or disputes concerning them.
